Litigation
Our firm mainly deals with different forms of litigation which arises during conduct of business and based on clients’ needs. Clients may have a wide range of disputes arising from diverse transactions and the remedy lies with the court. We prepare comprehensive opinions to our clients based on their disputes and allow them to make an independent decision before we commence the claims brought to us and/or defend the suits against our clients. We also advise clients on importance of resolving the disputes out of court before commencing litigation. We always have the interests of our clients at heart and we do our best to ensure all matters are concluded as soon as practicable.
At AJS, we have knowledge and capability of handling all kinds of disputes. We have handled a wide range of matters under this head including but not limited to;
a) Debt Recovery;
This falls under Civil litigation whereby we help clients recover money lent by various borrowers who have failed to reimburse the same and all internal efforts by our clients have proven futile. We start by attempting to resolve the matters amicably by the said borrowers and institute civil recovery proceedings on behalf of our clients where the said borrowers are difficult. We have thus successfully enabled various money lending institutions recover debts from stubborn borrowers. Our mode of approach is unique in style and in rare occasions do our clients write-off debts.
b) Labor and Human Resource Law
Labor and human law resource in Kenya mainly rotates on all fields of the employer/employee relationships. At AJS & Advocates we elaborately advice our clients on employment law mainly on issues revolving around the employment policies, termination and benefits of the same. We have not only successfully prosecuted matters concerning injury at workplace and compensation on behalf of our clients and claims on unfair termination but also defended them when they are sued.
c) Family Law
Stable families are a precedent to a stable society and economy thrives. We strive to negotiate win- win deals for peace to prevail among people of domestic connection. We apply law to settle distressed children and help find a home for the abandoned or orphaned. We organize people to take charge of their assets when living and after death through writing wills and managing intestate estate. In appropriate circumstances, we facilitate divorce taking care of all emotional needs of parties involved and distribute matrimonial property guided by existing legal regimes. We have also handled several custody and maintenance matters hence keeping the best interests of children at heart by ensuring they are brought up in a stable family environment.
The firm presents clients in family and children court proceedings as well a mediation session to ensure matters are expedited swiftly without injuring the relations between those involved. It is noteworthy that these proceedings are sensitive and always require high standards of professional care and confidentiality which our firm readily provides.
d) Insurance law
We have prosecuted and defended claims relating to personal injuries and material damage on behalf of various clients and provided post judgement procedures on their behalf. We have also negotiated claims where we represent diverse insurance companies and ensured those claiming under doctrine of subrogation are held personally liable and/or prove their claims strictly.
